In this alert:
- If you bank at JPMorgan Chase, they were “Hacked†and here are some of the things you can do to protect your assets.
- If you hire an Independent Contractor to do certain types of work you need to make certain of the finances and insurance or you could be liable for the employees of the independent contractor.
WARNING! IF YOU BANK AT JPMORGAN CHASE BANK
JPMORGAN CHASE REVEALED THIS WEEK that 76 MILLION HOUSEHOLDS WERE AFFECTED BY A CYBER ATTACK AGAINST THE BANK THIS SUMMER.
The bank said there is no evidence that hackers stole account numbers, passwords, birth dates or Social Security numbers.
BUT THE HACKERS WERE ABLE TO GET ACCESS TO CUSTOMERS’ NAMES, ADDRESSES, PHONE NUMBERS AND EMAIL ADDRESSES. Having access to this information is still a serious problem since Hackers will probably sell the information on the black market. Then the buyers of the illegal data will use it to trick you into giving them personal information to steal your money , open new credit card accounts in your name, even buy cars or other items in your name.
THERE ARE AT LEAST FOUR THINGS CHASE CUSTOMERS NEED TO WATCH OUT FOR:
- DON’T CLICK ON EMAIL LINKS After big data breaches, scammers start sending out emails. The emails may mention Chase, or past breaches. Never click on any links. Malware could be downloaded to your computer and steal account passwords and other information.
- WATCH THE MAIL YOU RECEIVE IN YOUR MAILBOX
Scammers could also send letters. Some might claim you’ve won a tablet, vacation or other prize and give you a phone number to call. DON’T DO IT. It’s probably a way to get more personal information from you or even have you send money by requesting information from your debit or credit card.
- HANG UP THE PHONE AND IGNORE TEXTS
Since phone numbers of Chase customers were stolen, be wary of calls asking for account numbers or other information. Crooks are sending texts now too, so don’t click any links from numbers you don’t know.
- DON’T OVERLOOK SMALL CHARGES
Crooks will charge smaller amounts to your credit card, usually under $10, to see if you notice, then charge a bigger amount later. Check online statements for suspicious activity once a week. If you are not sure or do not recognized it. CHALLENGE IT WITH THE CARD COMPANY OR WITH CHASE. (ap101314)
Do not bank on-line. Then the data from your account is not in your computer.
IN CALIFORNIA AS OF JANUARY 1, 2015 HIRE AN OUTSIDE CONTRACTOR TO DO WORK FOR YOUR BUSINESS AND YOU MIGHT FIND YOURSELF LIABLE FOR ANY INJURIES SUFFERED BY HIS WORK FORCE AND THE PAYROLL AS WELL AS OTHER LIABILITIES.
Existing law prohibits a person or entity from entering into a contract for labor or services with a construction, farm labor, garment, janitorial, security guard, or warehouse contractor, if the person or entity knows or should know that the contract or agreement does not include sufficient funds for the contractor to comply with laws or regulations governing the labor or services to be provided.
Effective January 1, 2015 this bill requires a client employer to share with a labor contractor all civil legal responsibility and civil liability for all workers supplied by that labor contractor for the payment of wages and the failure to obtain valid workers’ compensation coverage. The bill prohibits a client employer from shifting to the labor contractor legal duties or liabilities under workplace safety provisions with respect to workers provided by the labor contractor. The bill defines a client employer as a business entity that obtains or is provided workers to perform labor within the usual course of business from a labor contractor, except as specified. The bill defines a labor contractor as an individual or entity that supplies workers, either with or without a contract, to a client employer to perform labor within the client employer’s usual course of business. The bill excepts from the definition of labor contractor specified nonprofit, labor, and motion picture payroll services organizations and 3rd parties engaged in an employee leasing arrangement, as specified. The bill specifies that it does not prohibit client employers and labor contractors from mutually contracting for otherwise lawful remedies for violations of its provisions by the other party. The bill provides that waiver of its provisions is contrary to public policy, void, and unenforceable. (ab1897,Lab.C. 2810.3)
Before you hire an outside contractor to do work for you such as janitorial, read this very carefully to see if you can fit into one of its exceptions. For Example: this law does not include a business entity with a workforce of less than 25 workers, including those hired directly by the client employer and those obtained from, or provided by, any labor contractor nor a business entity with five or fewer workers supplied by a labor contractor or labor contractors to the client employer at any given time. Notwithstanding these two exemptions (there are others) consult your legal counsel. This cannot be relied upon as a legal opinion to or for anyone. To seek legal advice consult your attorney.
